Terms of Service

1. Agreement to Terms

By creating an account or using Healthy Boundaries ("the platform"), operated by MindWiz LLC ("we," "our," "the company"), a Florida limited liability company, you agree to these Terms of Service. If you do not agree, do not use the platform.

2. What Healthy Boundaries Is — and Is Not

What we are: A personal documentation and education platform for relationship health — self-assessment, experience logging, pattern recognition, psychoeducation, and report generation.

What we are not: Not a healthcare provider. Not a clinical instrument. Not a legal service. Not an emergency service. Not a substitute for professional help. We complement — but do not replace — therapy, legal counsel, medical care, or crisis intervention.

3. Eligibility

You must be at least 13 years old. Users 13-18 may use the platform. You must provide a valid email address. You may use a pseudonym for your display name.

4. Your Account

Security: You are responsible for maintaining credential security. We recommend a strong, unique password — especially if someone in your life might attempt to access your accounts.

Ownership: Your account belongs to you. No spouse, partner, parent (of users 18+), employer, or family member has a right to access your account. If someone pressures you to share your login, this may itself be a form of coercive control.

5. Subscription Plans and Payment

Free tier requires no payment. Paid tiers (Clarity, Clarity Pro, Clarity + Recovery) are billed monthly or annually. All charges appear as "HB Digital" — never "Healthy Boundaries."

Subscriptions auto-renew unless cancelled. No renewal reminder emails are sent by default to protect users whose email may be monitored. You may cancel at any time — cancellation takes effect immediately with access through your billing period.

Gift codes: Non-refundable once purchased. The purchaser never has access to the redeemer's account. Codes expire 12 months after purchase if not redeemed.

Professional Partner referral codes: Subject to the same privacy protections — the Partner never has access to your account or data.

6. Your Data and Content

You own your data. All content you create belongs to you. We claim no ownership. By using the platform, you grant us a limited license to store and process your content to you for providing the service.

When you export a PDF, you create a file on your device. You are responsible for how it is stored, shared, and used. Consult with an attorney before submitting reports in legal proceedings.

7. Acceptable Use

You agree not to: use the platform to harass or harm another person, create accounts to monitor or surveil someone, enter false information to defraud a court, attempt to access another user's data, reverse-engineer the platform, use bots or scrapers, or resell access.

7.1 Communication Imports

When using the communication import and pattern analysis features, you additionally agree that:

  • You will only upload communications where you are a participant or where you have legal authorization to access the data
  • You are solely responsible for ensuring any uploaded recordings were made in compliance with applicable federal and state wiretapping and eavesdropping laws, including but not limited to two-party consent laws in states such as Florida (§ 934.03), California, Illinois, Maryland, and Massachusetts
  • The platform parses and analyzes data you provide — it does not independently intercept, monitor, or access any communications
  • The platform does not verify the authenticity, completeness, or chain of custody of uploaded communications
  • Pattern observations generated by the platform (including contact frequency, timing distribution, and direction balance) are data summaries based on the files you upload, not legal or clinical determinations of harassment, stalking, abuse, or any other legal characterization
  • You are responsible for consulting with a qualified attorney before using communication pattern data in any legal proceeding, including but not limited to restraining order applications, custody proceedings, or criminal complaints
  • Healthy Boundaries assumes no liability for legal consequences arising from the upload of communications that were obtained or recorded in violation of applicable law

8. Accuracy and Limitations

Research-informed, not clinically validated. Our methodology is informed by 69 published sources but has not undergone independent clinical validation. Scores are based on self-reported data and algorithmic processing — not professional clinical judgment. Results should be interpreted as educational information, not diagnosis.

Not a comprehensive safety assessment. No automated tool can fully assess danger. If you feel unsafe, trust your instincts and contact professional support.

9. Professional Partner Program

Professional Partners never access client data through our platform. They receive referral codes, educational materials, co-branded exports, and directory listings. Healthy Boundaries does not verify credentials of listed professionals — users should independently verify qualifications.

10. Intellectual Property

The platform's behavior database, scoring methodology, educational content, design, and code are the intellectual property of MindWiz LLC. Research references are for educational attribution — they do not imply endorsement or partnership. You retain all rights to content you create.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR MEET YOUR SPECIFIC REQUIREMENTS. YOUR USE IS AT YOUR OWN RISK.

12. Limitation of Liability

HEALTHY BOUNDARIES AND MINDWIZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify Healthy Boundaries and MindWiz LLC from any claims arising from your use of the platform, violation of these Terms, or content you create or share.

14. Dispute Resolution

Governed by Florida law. Before filing legal action, contact legal@healthyboundaries.living for informal resolution (30 days). Jurisdiction: state or federal courts in Palm Beach County, Florida.

15. Termination

By you: Delete your account at any time. By us: We may suspend accounts that violate these Terms, with notice and opportunity to export data.

16. Changes

Material changes communicated through the platform. Continued use constitutes acceptance.
